A Design Patent may be granted to anyone who is looking to protect the shape, pattern or ornamentation applied to a useful article that is mass-produced. It gives the owner the right “to exclude others from making, using, offering for sale or selling the invention throughout the territory the patent was granted. Design patents are protected for 14 years in the US and 10 in Canada.

The complete process for obtaining a design patent can be spread over a period and take as long as 12 months. Once you receive the design patent, no one can manufacture, sell or use your design/invention without your permission. This monopoly is valid for only the countries it was granted in.

A search among designs already registered in the U.S. will be carried out to check if yours is new or if on the contrary it has already been registered. If no similar design was identified we will immediately register a design patent for your design in Canada and the U.S.*
